North Sider Slaps Judge and Spits on Her Over a Smoke: Cops

David Nicosia is accused of battery and a hate crime in the altercation outside the Daley Center with a 79-year-old African-American judge.

A Chicago man belittled an elderly African-American judge, spat on her, slapped her in the face and called her "Rosa Parks" — all because he wanted her to stop puffing on a cigarette during a break outside the Daley Center.

David Nicosia, 55, who stands 6-foot and weighs 240 pounds, was jailed in lieu of $90,000 bail on Tuesday. He faces aggravated battery charges and a hate crime charge, according to Cook County prosecutors.

The incident took place Monday afternoon near the Daley Center when Nicosia told the judge he wanted her to stop smoking. An argument ensued, and authorities said Nicosia spit in the 79-year-old judge's face.

The man walked away but the judge followed him, they argued further and Nicosia then slapped her left cheek, according to the sheriff's department.

“He slapped her for no reason,” said Judge James Brown, who set bail and noted that Nicosia was "a danger to the community."
